Texas IEP evaluation deadlines

How long a Texas school district has — to answer your request, to finish the evaluation, and to meet — with the law cited for every number.

Texas's clock

The district must respond to a written request within 15 school days (Tex. Educ. Code §29.004(c); 19 TAC §89.1011(b)).

After you sign consent, the evaluation must be finished within 45 school days (Tex. Educ. Code §29.004(a)(1); 19 TAC §89.1011(c)).

Recording a meeting: one-party (Tex. Penal Code §16.02(c)(4)).

If the school misses: state complaint — allege a violation from the last 1 year (34 CFR §300.153(c)); due process — 2 years from when you knew or should have known (34 CFR §300.507(a)(2)).

Verified Texas details

  • Written request → within 15 school days the district must give you the consent form or a written refusal. A verbal request does not start this clock.
  • Consent → written evaluation report (FIIE) by the 45th school day. If your child is absent 3 or more school days during the count, the deadline extends by the total absence days.
  • Consent 35–44 school days before the last day of school → report due by June 30, ARD by the 15th school day of next year. Under 35 → the count carries into next year.
  • Report → ARD meeting within 30 calendar days; you get the report at least 5 school days before the meeting.
  • Recording: Texas is one-party consent (§16.02(c)(4)), but districts may regulate recording at meetings under their own policies — expect a policy layer.
