Vermont IEP evaluation deadlines

How long a Vermont school district has — to answer your request, to finish the evaluation, and to meet — with the law cited for every number.

Vermont's clock

State law sets no separate response deadline — federal law governs: the dated written request is still what starts everything, and a refusal must come with prior written notice.

After you sign consent, the evaluation must be finished within 60 calendar days (Vermont Special Education Rules, Rule 2362 series (evaluation completed and report issued within 60 calendar days of consent)).

Recording a meeting: one-party (No VT wiretap statute; federal 18 U.S.C. 2511(2)(d)).

If the school misses: state complaint — allege a violation from the last 1 year (34 CFR §300.153(c)); due process — 2 years from when you knew or should have known (34 CFR §300.507(a)(2)).
